SMS/Text Messaging Terms and Conditions

These SMS/Text Messaging Terms and Conditions (“SMS Terms”) govern your use of text messaging services provided by Record Rx, LLC (“Record Rx,” “RecordRx,” “we,” “our,” or “us”) in connection with our medical records coordination services. By providing your mobile phone number to Record Rx during signup or in your account, you consent to receive transactional text messages from us as described below. These SMS Terms supplement, and are in addition to, our Terms and Conditions and Privacy Policy.
A. Purpose of SMS Messages
Record Rx uses SMS/text messaging solely for transactional and operational purposes related to your account and the records coordination services we provide. We do not use SMS for marketing or promotional purposes, and we will not send you marketing or promotional text messages. The transactional messages you may receive from Record Rx include, without limitation:
- One-time passcodes and verification codes used to confirm your mobile phone number at signup or to authenticate access to your account;
- Notifications confirming that your account has been created or that an action you initiated has been received;
- Notifications regarding the status of your records request, including confirmation of receipt of authorization, scheduling of your telehealth visit through our contracted clinical network, completion of your telehealth visit, and delivery of your completed records package;
- Operational alerts relating to security, suspected unauthorized access, or required action on your account;
- Customer service responses to messages you initiate.
B. Consent and Frequency
By providing your mobile phone number to Record Rx, you expressly consent to receive transactional text messages from Record Rx and its service providers at that number using an automatic telephone dialing system or other automated means. Your consent is not a condition of purchase of any product or service, except that we may be unable to provide certain account-security features (such as multi-factor authentication via SMS) without it. Message frequency varies based on your account activity. You may receive messages from time to time as transactions occur on your account.
C. Message and Data Rates
Record Rx does not charge you a fee to send or receive text messages. However, message and data rates may apply depending on your wireless carrier and mobile plan. Please consult with your wireless carrier for applicable text messaging fees.
D. Carrier Support and Delivery
Supported mobile service providers include the major U.S. wireless carriers, including Verizon Wireless, AT&T, T-Mobile, and U.S. Cellular, as well as many regional carriers. Carrier support is subject to change without notice. Alerts sent via SMS may not be delivered if your mobile phone is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of the wireless operator may interfere with message delivery, including your equipment, terrain, proximity to buildings, foliage, and weather. Wireless operators do not guarantee message delivery and will not be held liable for delayed or undelivered messages. Record Rx will not be liable for any delays in the receipt of any SMS message, as delivery is subject to effective transmission from your network operator. We may modify or terminate our SMS messaging services from time to time, for any reason and without notice, including the right to terminate text messaging without notice, without liability to you, any other user, or any third party.
E. Opt-Out
You may stop receiving non-essential text messages from Record Rx at any time by replying STOP to any message from us. You expressly consent to receipt of a final text message from us confirming your STOP request. After you opt out, we may still send you transactional messages that are necessary for the operation of your account or required by law (for example, security-related notifications), and we may attempt to contact you by other means (such as email) regarding the status of your records request. If you opt out of SMS messaging, certain account-security features such as SMS-based multi-factor authentication will no longer be available to you. You may also be required to verify your phone number again by other means if you re-enable SMS messaging in the future. To re-enable SMS messaging, reply START or UNSTOP to any prior message from us, or update your communication preferences in your account.
F. Privacy
Text-messaging originator opt-in data and consent will not be shared with any third parties or affiliates for marketing or promotional purposes. We do not rent or sell your Personal Information (including mobile data or opt-in data) to third parties or affiliates for marketing or promotional purposes. G. Updating your Mobile Number
It is your responsibility to maintain the accuracy of the mobile phone number on file with Record Rx. If you change your mobile phone number, you agree to promptly update your account information so that text messages intended for you are not sent to a person who has been reassigned your former number.
H. Changes to these SMS Terms
We may revise these SMS Terms from time to time. Any changes will become effective when the revised SMS Terms are posted on our website. Your continued use of our SMS messaging services after such posting constitutes your acceptance of the revised SMS Terms.
